1. Introduction:

Pagoda Travel provides a platform connecting travel agents, guides, and Destination Management Companies (DMCs) to collaborate on custom travel itineraries. By using our Services, you agree to these Terms.

2. Marketplace Nature / Third-Party Responsibility

  • Pagoda Travel is a neutral facilitator. We do not provide travel services ourselves.
  • All service agreements, bookings, and liabilities are solely between service providers (guides, operators, DMCs, agents) and clients.
  • Our platform may display information, quotes, or pricing from third-party providers. We do not guarantee the accuracy, completeness, or reliability of any third-party content.
  • Any reliance on third-party information, pricing, or services is at your own risk.

3. User Responsibilities

You agree to:

  • Provide accurate and truthful information.
  • Act professionally and ethically, complying with all applicable laws.
  • Respect cultural norms, privacy, and maintain honesty in all interactions.
  • Avoid disruptive, harmful, or unlawful activity on the platform.

4. Fees

  • Pagoda Travel offers a free plan and optional paid tiers or white-label services.
  • Fees and payment terms will be communicated transparently before you opt in.

5. Intellectual Property

  • All content, technology, branding, and materials on Pagoda Travel are the property of Pagoda Travel or its licensors.
  • You may not reproduce, modify, or distribute our intellectual property without written permission.

6. Limitation of Liability

  • Pagoda Travel is not liable for:
    • The conduct, performance, or services of guides, DMCs, or travel agents.
    • Errors, omissions, or discrepancies in third-party information, quotes, or pricing.
    • Any indirect, incidental, special, consequential, or punitive damages, including lost profits or revenue.
  • Your use of the Services is at your own risk. Our total liability, if any, will not exceed the fees you have paid to us for the Services.

7. Indemnification

You agree to indemnify, defend, and hold harmless Pagoda Travel, its affiliates, officers, and employees from any claims, losses, or damages arising out of:

  • Your use of the platform.
  • Your reliance on third-party information or services.
  • Any violation of these Terms.
  • Any disputes with other users or clients.

8. Professional Waiver for Guides, Operators & DMCs

By joining Pagoda Travel, guides, operators and DMCs acknowledge:

  • They are responsible for compliance with local laws, licenses, and insurance.
  • Pagoda Travel is not responsible for service delivery or disputes.
  • They indemnify Pagoda Travel against any claims arising from their services.

9. Support & Dispute Policy

  • Submit support requests via hello@pagoda.travel or in-app support.
  • We aim to acknowledge issues within 24 business hours and investigate within 3 business days.
  • Pagoda Travel facilitates communication but remains neutral and is not responsible for outcomes of travel services.
  • Users may pursue independent legal action for unresolved disputes.

10. Governing Law

These Terms are governed by the laws of Hong Kong, without regard to its conflict of law principles. All disputes are subject to the exclusive jurisdiction of the Hong Kong courts.

11. Modifications

Pagoda Travel may update these Terms at any time. Changes are effective immediately upon posting. Continued use of the Services constitutes acceptance of updated Terms.
